1 Gegenstand der Teilnahme- und Nutzungsbedingungen

(1) Die Panasonic Marketing Europe GmbH, Hagenauer Str. 43, 65203 Wiesbaden (nachfolgend „Panasonic“ genannt) stellt hiermit eine Webseite zur Verfügung (nachfolgend „Webseite“ genannt), über welche die ordnungsgemäß angemeldeten Teilnehmer Informationen im Zusammenhang mit Produkten von Panasonic erhalten („Dienste“).
(2) Die vorliegenden Teilnahme- und Nutzungsbedingungen regeln die Zurverfügungstellung der Dienste durch Panasonic und die Nutzung dieser Dienste durch Sie als ordnungsgemäß angemeldeten Teilnehmer.
(3) Wenn Sie die Dienste nutzen möchten, müssen Sie zunächst diesen Bedingungen zustimmen und sich auf der Panasonic Webseite registrieren.
(4) Indem Sie sich für den Dienst und/oder die Nutzung dieser Seite registrieren, erklären Sie sich mit den vorliegenden Bedingungen einverstanden

2 Änderungen der Teilnahme- und Nutzungsbedingungen

(1) Panasonic behält sich vor, diese Teilnahme- und Nutzungsbedingungen jederzeit mit Wirksamkeit auch innerhalb der bestehenden Vertragsverhältnisse zu ändern.

3 Ihre Anmeldung auf der Webseite

Die während des Anmeldevorgangs von Panasonic erfragten Kontaktdaten und sonstigen Angaben müssen von Ihnen vollständig und korrekt angegeben werden. Bei der Anmeldung einer juristischen Person ist zusätzlich die vertretungsberechtigte natürliche Person anzugeben.

4 Verantwortung für die Zugangsdaten

(1) Die Zugangsdaten einschließlich des Passworts sind von Ihnen geheim zu halten und unbefugten Dritten nicht zugänglich zu machen.
(2) Es liegt weiter in Ihrer Verantwortung sicher zu stellen, dass Ihr Zugang zur Webseite und die Nutzung der auf der Webseite zur Verfügung stehenden Dienste ausschließlich durch Sie bzw. durch die von Ihnen bevollmächtigten Personen erfolgt.
Sie haften für jedwede Nutzung und/oder sonstige Aktivität, die unter Ihren Zugangsdaten ausgeführt wird, nach den gesetzlichen Bestimmungen.

5 Aktualisierung der Teilnehmerdaten

Sie sind dazu verpflichtet, Ihre Daten (einschließlich Ihrer Kontaktdaten) aktuell zu halten. Tritt während der Dauer Ihrer Teilnahme eine Änderung der angegebenen Daten ein, so haben Sie die Angaben unverzüglich auf dem Portal in Ihren persönlichen Einstellungen zu korrigieren. Sollte Ihnen dies nicht gelingen, so teilen Sie uns Ihre geänderten Daten bitte unverzüglich per E-Mail oder Telefax mit.

6 Diensteangebot und Verfügbarkeit der Dienste

(1) Panasonic stellt Ihnen auf der Webseite Dienste zur Verfügung. Inhalt und Umfang der Dienste bestimmen sich nach den jeweils aktuell auf der Webseite verfügbaren Funktionalitäten.
(2) Ein Anspruch auf die Nutzung der auf der Webseite verfügbaren Dienste besteht nur im Rahmen der technischen und betrieblichen Möglichkeiten von Panasonic. Panasonic bemüht sich um eine möglichst unterbrechungsfreie Nutzbarkeit seiner Dienste. Jedoch können durch technische Störungen (wie zB Unterbrechung der Stromversorgung, Hardware- und Softwarefehler, technische Probleme in den Datenleitungen) zeitweilige Beschränkungen oder Unterbrechungen auftreten.
(3) Für die Schaffung der in Ihrem Verantwortungsbereich zur vertragsgemäßen Nutzung der Dienste notwendigen technischen Voraussetzungen sind Sie selbst verantwortlich

7 Änderungen von Diensten

Panasonic ist jederzeit berechtigt, auf der Webseite bereitgestellte Dienste zu ändern, neue Dienste unentgeltlich verfügbar zu machen und die Bereitstellung unentgeltlicher Dienste einzustellen.

8 Schutz der Inhalte, Verantwortlichkeit für Inhalte Dritter

(1) Die auf der Webseite verfügbaren Inhalte sind überwiegend geschützt durch das Urheberrecht oder durch sonstige Schutzrechte und stehen jeweils im Eigentum von Panasonic, der anderen Teilnehmer oder sonstiger Dritter, welche die jeweiligen Inhalte zur Verfügung gestellt haben. Die Zusammenstellung der Inhalte als Solche ist ggf. geschützt als Datenbank oder Datenbankwerk iSd. §§ 4 Abs. 2, 87a Abs. 1 UrhG. Sie dürfen diese Inhalte lediglich gemäß diesen Teilnahme- und Nutzungsbedingungen sowie im auf der Webseite vorgegebenen Rahmen nutzen.

9 Verbotene Aktivitäten

(1) Ihnen sind jegliche Aktivitäten auf bzw. im Zusammenhang mit der Webseite  untersagt, die gegen geltendes Recht verstoßen, Rechte Dritter verletzen oder gegen die Grundsätze des Jugendschutzes verstoßen. Insbesondere sind Ihnen folgende Handlungen untersagt:
–  das Einstellen, die Verbreitung, das Angebot und die Bewerbung pornografischer, gegen Jugendschutzgesetze, gegen Datenschutzrecht und/oder gegen sonstiges Recht verstoßender und/oder betrügerischer Inhalte, Dienste und/oder Produkte;
–  die Verwendung von Inhalten, durch die andere Teilnehmer oder Dritte beleidigt oder verleumdet werden;
–  die Nutzung, das Bereitstellen und das Verbreiten von Inhalten, Diensten und/oder Produkten, die gesetzlich geschützt oder mit Rechten Dritter (zB Urheberrechte) belastet sind, ohne hierzu ausdrücklich berechtigt zu sein.
(2) Des Weiteren sind Ihnen auch unabhängig von einem eventuellen Gesetzesverstoß bei der Einstellung eigener Inhalte auf der Webseite sowie bei der Kommunikation mit anderen Teilnehmern  die folgenden Aktivitäten untersagt:
–  die Verbreitung von Viren, Trojanern und anderen schädlichen Dateien;
–  die Versendung von Junk- oder Spam-Mails sowie von Kettenbriefen;
–  die Verbreitung anzüglicher, anstößiger, sexuell geprägter, obszöner oder diffamierender Inhalte bzw. Kommunikation sowie solcher Inhalte bzw. Kommunikation die geeignet sind/ist, Rassismus, Fanatismus, Hass, körperliche Gewalt oder rechtswidrige Handlungen zu fördern bzw. zu unterstützen (jeweils explizit oder implizit);
–  die Belästigung anderer Teilnehmer, zB durch mehrfaches persönliches Kontaktieren ohne oder entgegen der Reaktion des anderen Teilnehmers sowie das Fördern bzw. Unterstützen derartiger Belästigungen;
–  die Aufforderung anderer Teilnehmer zur Preisgabe von Kennwörtern oder personenbezogener Daten für kommerzielle oder rechts- bzw. gesetzeswidrige Zwecke;
–  die Verbreitung und/oder öffentliche Wiedergabe von auf dem Portal verfügbaren Inhalten, soweit Ihnen dies nicht ausdrücklich vom jeweiligen Urheber gestattet oder als Funktionalität auf dem Portal ausdrücklich zur Verfügung gestellt wird.
(3) Ebenfalls untersagt ist Ihnen jede Handlung, die geeignet ist, den reibungslosen Betrieb der Webseite zu beeinträchtigen, insbesondere die Systeme von Panasonic übermäßig zu belasten.
(4) Bei Vorliegen eines Verdachts auf rechtswidrige bzw. strafbare Handlungen ist Panasonic berechtigt und ggf. auch verpflichtet, Ihre Aktivitäten zu überprüfen und ggf. geeignete rechtliche Schritte einzuleiten. Hierzu kann auch die Zuleitung eines Sachverhalts an die Staatsanwaltschaft gehören.

Abschnitt 10: Exporte

(1) Sie verpflichten sich zur Einhaltung aller Exportgesetze und Ausfuhrbestimmungen, denen Sie bei der Nutzung der Website unterliegen. Das Unternehmen ist in keinem Fall an Bedingungen gebunden, die gegen Exportgesetze und Ausfuhrbestimmungen betroffener Länder, insbesondere Japans, verstoßen oder diese einschränken. Für Bestellungen sind grundsätzlich alle Lizenzen einzuholen, die wie oben erwähnt nach den hierfür geltenden Gesetzen erforderlich sind.
(2) Sie verpflichten sich, die Inhalte NICHT für „militärische Zwecke“ zu verwenden und sie – weder im In- noch Ausland – NICHT an Händler oder Kunden zu verkaufen, zu vermieten, zu liefern oder anderweitig zu veräußern, die sie möglicherweise für „militärische Zwecke“ verwenden könnten. „Militärische Zwecke“ meint im Sinne dieses Artikels die Konstruktion, Entwicklung, Herstellung, Verwendung oder Lagerung jeglicher Art von Waffen, u. a. nuklearer, chemischer und biologischer Waffen sowie Raketen.
(3) Sie dürfen weder direkt noch indirekt in Länder exportieren, gegen die nach den Resolutionen des Sicherheitsrats der Vereinten Nationen wirtschaftliche Sanktionen verhängt wurden, soweit es sich bei den Inhalten um verbotene Produkte handelt, deren Export in die sanktionierten Länder demgemäß unzulässig ist.

11 Sperrung von Zugängen

(1) Panasonic kann Ihren Zugang zu der Webseite vorübergehend oder dauerhaft sperren, wenn konkrete Anhaltspunkte vorliegen, dass Sie gegen diese Teilnahme- und Nutzungsbedingungen und/oder geltendes Recht verstoßen bzw. verstoßen haben, oder wenn Panasonic ein sonstiges berechtigtes Interesse an der Sperrung hat. Bei der Entscheidung über eine Sperrung wird Panasonic Ihre berechtigten Interessen angemessen berücksichtigen.

12 Haftungsbeschränkung

Sollten Ihnen durch die Nutzung von auf dem Portal zur Verfügung gestellten Diensten (einschließlich des Abrufs von kostenlosen Inhalten) ein Schaden entstehen, so haftet Panasonic nur, soweit Ihr Schaden aufgrund der vertragsgemäßen Nutzung der Inhalte und/oder Dienste entstanden ist, und nur bei Vorsatz (einschließlich Arglist) und grober Fahrlässigkeit von Panasonic.

13 Sonstiges

(1) Sollte eine Bestimmung dieser Teilnahme- und Nutzungsbedingungen unwirksam sein oder werden, so bleibt die Rechtswirksamkeit der übrigen Bestimmungen hiervon unberührt. An Stelle der unwirksamen Bestimmung gilt eine wirksame Bestimmung als vereinbart, die der von den Parteien gewollten wirtschaftlich am nächsten kommt.
(2) Es gilt das Recht der Bundesrepublik Deutschland.

2. What is Personal Information?

When you create a Panasonic profile on Partner Programme and Partner Academy

When you create an account or profile on a Panasonic website or application (such as sign up to be a Panasonic Partner), we ask you to provide certain Personal Information, including your company details, your name, email address, job title and telephone number. Any Panasonic account you create will be password-protected. We use your name and company details to give you access to a programme where benefits are linked to your activity. We ask you to select the categories you want to have access to and we check with our sales representative your company is entitled to access these categories. We identify you and your company profile, in order to define what your type of access should be, according to your company profile (distributor, reseller, rental,..). We use these information to provide you with a personalized web site access, where content is defined by your country, your profile and the categories you have been approved for. We use this information to provide you with customer support. We may access your relevant Panasonic profile/account, in order to provide you with the necessary assistance or support you require or have requested.

When you communicate with Panasonic

When you contact us or interact with our customer support representatives via email, telephone or in person, we may collect Personal Information, such as your name, mailing address, phone number, email address and contact preferences; and we may also collect information about the Panasonic products or devices you own, such as their serial numbers and date of purchase. We also may create logs/reports that are useful in diagnosing product or application performance related issues, and capture information relating to the issue. We use this information to provide you with customer and product support. We may access your 'My Panasonic' Profile, or other relevant Panasonic profile/account, in order to provide you with the necessary assistance or support you require or have requested. We may also record and review your conversations with our customer support representatives (e.g. when you contact us by telephone), for training and complaints handling, and also to review any information you have provided in response to a voluntary customer survey(s). We may collect information about your use of our Services through software on your Panasonic device/product and other means, or your use of our online applications. For example, we may collect:

Device/product information - such as your hardware model, device/product IMEI number, the MAC address of the device’s wireless network interface and the mobile phone number used by the device), mobile network information, your mobile operating system, the type of mobile browser you use, time zone setting, and other unique device identifiers, IP address, operating system details, and settings of the device you use to access the Services.

  2. Log information - such as the time and duration of your use of the Service, search query terms you enter through the Services, and any information stored in cookies that we have set on your product/device or our application.

  3. Location information - such as your product or device’s GPS signal or information about nearby WiFi access points and cell towers that may be transmitted to us when you use certain Services. Some of our location-enabled Services require your Personal Information for the feature to work. Subscriptions and newsletters

Where you subscribe to our promotional communications and newsletters we may collect Personal Information from you in order to enable us to provide this service to you. When you upload Personal Information to a Panasonic website or online application

In addition to the above, we may collect such other Personal Information that you provide by uploading content (e.g. video or photos) onto our websites or online applications. If you have opted-in to our tracking cookies, our Marketing automation systems will track your website and campaign response activities (such as trade shows attended or Newsletters clicked). We do this in order to understand our customers better and customise marketing communications for relevancy.

5. To whom do we disclose your information?

We will not disclose your Personal Information to third parties for their own independent marketing or business purposes without your consent. However, we may disclose your information to the following entities:

    We may need to transfer your Personal Information to other Panasonic Affiliates to provide the Services you require or any other services/assistance you request.   2. Academy e-learning platform provider

    We offer training via e-learning platform “Panasonic Academy”. This platform is also used to register for Face to face training attendance. The Panasonic Academy web service is provided by CAT
    We may need to transfer your Personal Information to our provider CAT to provide the e-learning Services you require.

  3. Service Providers

    We use third party service providers to help us to administer certain activities and services on our behalf, such as call centre providers used by Panasonic to service our customers, data supply, data cleaning, fulfilling your purchases and delivering products, processing credit card payments, sending postal mail and emails, sending text messages (SMS), providing advertisements, analysing usage of our Services, tracking effectiveness of our marketing campaigns, allowing users to connect to their social network, providing fraud checking services and customer support services. We may share Personal Information about you with such third party service providers solely for the purpose of enabling them to perform services on our behalf and they will operate only in accordance with our instructions.     We may provide your Personal Information, such as your email address, to certain social networking providers so that they can help us display advertisements about our Services on your social network pages. We will only share your Personal Information with social networking providers in accordance with your marketing preferences and any applicable laws.

    We prepare and develop anonymous, aggregate or generic data and statistics for various reasons (as indicated in this Privacy Notice). As this data is anonymous (i.e. you cannot be identified from it) we do not consider this information to be Personal Information. As such, we may share it with any third party (such as our Affiliates, partners, advertisers or otherwise).

    We may disclose your Personal Information to a third party (or other Panasonic Affiliate) as part of a reorganisation, merger, transfer, sale, joint venture, assignment or other disposition of all or any portion of Panasonic's business, assets or stock, including, without limitation, in connection with any bankruptcy or similar proceeding.

    We may disclose your Personal Information to third party sponsors of sweepstakes, contests, free prize draws, competitions and similar promotions. These third party providers will be identified to you prior to when you enter into any competition, sweepstake, prize draw or similar promotion.

A number of Panasonic's Services give you the option and ability to upload and share certain Personal Information, such as, messages, photos, videos and other content. 6. What do we do to keep your information secure?

Panasonic have put in place appropriate rigorous physical and technical measures to safeguard the Personal Information we collect in connection with our Services. However, please note that although we take appropriate rigorous steps to protect your Personal Information, no website, product, device, online application or transmission of data, computer system or wireless connection is completely secure and therefore we cannot guarantee the security of your Personal Information.

International Transfer of Data

The Personal Information that we collect from you may be stored and processed in your region, or transferred to, stored at or otherwise processed outside the European Economic Area ("EEA"), including Japan or in any other country where Panasonic or its Affiliates, subsidiaries or service providers maintain facilities.

Encryption

All Personal Information you provide to us is stored on our secure servers. Where we have given you (or where you have chosen) a password that enables you to access certain Services, such as you My Panasonic Profile, you are responsible for keeping this password confidential and we ask you not to share your password with anyone.

Other security measures

Information security, including the protection of Personal Information is organized in a global Panasonic Program called “Information Security Management” (ISM). The aim, standards and implementation measures are organized in a globally valid Policy, standards and guidelines. All central European IT systems are externally assessed and fall under the regulation of ISO 27001 certification. The program and all its parts follow a strong yearly PDCA approach to secure the confidentiality, integrity and availability of all data for the whole information lifecycle from collection to destruction of such information.

Using social media and forum features

Certain Services include social networking, chat room or forum features. You should ensure that when using these features that you do not submit any personal Information that you do not want to be seen, collected or used by other users.

 

7. Accessing your Personal Information and other rights you have

Panasonic will collect, store and process your Personal Information in accordance with your rights under any applicable data protection laws.

Your rights under applicable data protection laws include, the right to access a copy of your Personal Information, the right to request the deletion or updating of any inaccurate Personal Information and the right to object, in some cases, to our processing of your Personal Information. We will respond to your request without undue delay and by no later than one month from receipt of any such request, unless a longer period is permitted by applicable data protection laws, and we may charge a reasonable fee for dealing with your request which we will notify to you. 8. Data Retention ? How long we will store/keep your Personal Information

We will retain your Personal Information for the period necessary to fulfil the purposes for which your Personal Information has been collected.

In particular, we classify Personal Information into the following specific categories with different retention periods:

  • Competition entrants - 1 year.

  • Marketing opt-ins - Will remain as an opt-in until you unsubscribe at which point your information will be retained on a suppression list in order to ensure that we comply with your request.

  • Contact us sales forms or inbound telephone sales inquiries - 1 year.

  • Warranty registrations and customer service calls - 5 years. We may need to contact you in case of product recalls (health and safety).

  • Customers and partners - 6 years from the last time we engage with you (email, meeting, telephone call).

Please note:  If your Personal Information belongs to more than one category, the longest retention period will prevail. When your Personal Information is no longer required for the purpose it was collected or as required by applicable law, it will be deleted and/or returned to you in accordance with applicable law.

Our websites, applications and products may contain links to other third party websites that are not operated by Panasonic, and our websites or your product and devices may contain applications that you can download from third parties. We and other Panasonic Affiliates may use your Personal Information (such as your contact details (e.g. name, address, email address, telephone number)) to send you marketing-related correspondence by post, email, telephone and/or text message (SMS) related to Panasonic products, devices and other Services in accordance with your email and contact preferences Panasonic Subscription Centre.or as you otherwise agree to.

When you purchase Panasonic products or device, contact our customer support representatives, create an account or profile for one of our Services (such as a My Panasonic Profile or eShop account), or subscribe to one of our Services, you may be given the opportunity to opt-in to (or where permitted by applicable law, opt-out of) the receiving of such marketing-related correspondence.

We do not share Personal Information with third parties for the third parties’ marketing purposes.

We may also use your Personal Information to personalise and to target more effectively our marketing communications to ensure, to the extent possible, that any marketing-related correspondence is relevant to you.

Where we do collect Personal Information from children, we will always use reasonable efforts to verify that consent has been given or authorised by the child's parent or guardian.

    If we become aware that Personal Information that has been submitted to us relates to a child without the consent of a parent or guardian, we will use reasonable efforts to:

    • delete that Personal Information as soon as possible; or
