Section 1: Subject Matter of the Terms of Use
(1) Panasonic Marketing Europe GmbH, Hagenauer Str. 43, 65203 Wiesbaden, Germany (hereinafter referred to as „Panasonic“) hereby provides a website (hereinafter referred to as the „Website“) via which duly registered users receive information relating to Panasonic’s products (hereinafter referred to as the “Services”).
(2) The provision of the Services by Panasonic and the use of such Services by you as a duly registered user shall be subject to these present terms of use.
(3) If you wish to use the Services, you must first agree to these terms and register with Panasonic’s website.
(4) By registering for the Services and/or by the use of this website, you agree to these present terms.

(1) Panasonic reserves the right to change these terms of use at any time, effective for new and existing contracts.

You shall be obliged to keep your data, including your contact data, up to date. Should the data you provided change during the time you use the Website, you shall be obliged to correct such data on the portal in your personal settings. (1) On the Website, Panasonic places Services at your disposal. The contents and scope of such Services shall be subject to the functionalities as available on the Website from time to time.

To the extent possible, Panasonic shall endeavour to provide uninterrupted usability of its Services. However, technical malfunctions, such as interruption of power supply, hardware and software errors, technical problems within the data lines may cause temporary restrictions or interruptions.
(3) You shall be responsible for the provision of the technical prerequisites necessary for the use of the Services in accordance with the contract within your scope of responsibility.

Panasonic shall be entitled at any time to change the Services provided on the Website, to make available new Services free of charge and to cease to provide free Services.
Section 8: Protection of Contents, Liability for Third Party Contents
(1) The contents made available on the Website shall be mostly protected by copyright or other property rights and are the property of Panasonic, of the other users or of other third parties that provided such contents. Any compilation of the contents as such is protected as a data base or data base work for the purposes of section 4, paragraph 2 and section 87a, paragraph 1 of the Copyright Act (UrhG). You may only use these contents in accordance with these present terms of use as well as within the scope described on the Website.
Section 9: Prohibited Activities
- Any activities on and/or in connection with the Website that violate applicable law, third-party rights or the principles of the protection of minors shall be prohibited. In particular, the following activities shall be prohibited:
– uploading, distributing, offering and marketing contents of a pornographic nature, that violate laws for the protection of minors, data protection law and/or any other law, and/or fraudulent contents, services and/or products;
– the use of contents by which other users or any third party are insulted or defamed;
– the unauthorised use, provision and distribution of contents, services and/or products protected by law or subject to third-party rights (such as copyrights).
(2) In addition, when you upload your own contents to the Website as well as when you communicate with other users, the following activities shall be prohibited, irrespective of whether any law is violated or not:
– the distribution of viruses, Trojans and other harmful files;

– the distribution of insinuating, offensive, sex-related, obscene or defaming contents and/or communications as well as of contents and/or communications that are suitable to support or promote racism, fanaticism, hate, physical violence or unlawful acts (in each case express or implied);

– to request other users to disclose passwords or personal data for commercial or illegal purposes;
– the distribution and/or public disclosure of contents available on the portal to the extent such disclosure is not expressly permitted by the relevant author or unless such contents are expressly provided as a functionality on the portal.
(3) Any action that is suitable to negatively affect the smooth operation of the Website, in particular to generate excessive traffic shall also be prohibited.
(4) In case of any suspected illegal and/or punishable act, Panasonic shall be entitled and may be obliged to verify your activities and to implement suitable legal measures. This may include forwarding the facts to the public prosecutor’s office.
Section 10: Exports
(1) You agree to comply with all the export laws and regulations applicable to your use of the Website. In no event shall Company be bound by any terms and conditions that contravene any export laws, regulations or other restrains of any relevant countries including but not limited to Japan. All orders are subject to obtaining of any required license under the said relevant laws.
(2) You agree NOT to use the Content for “Military Purpose”, and NOT to sell, lease, provide or otherwise dispose of the Content, both overseas shipments and domestic shipments, to any dealers or customers who may make use of the Content for “Military Purpose”. For the purpose of this Article, “Military Purpose” means the design, development, manufacture, use or stockpiling of any weapons, including, without limitation, nuclear weapons, chemical weapons, biological weapons and missiles.
(3) You shall not export, directly or indirectly, to any of the countries against which any economic sanction is imposed under resolutions approved by the Security Council of the United Nations, so far as the Content remains the prohibited subject whose export to such countries is prohibited thereunder.

(1) Panasonic shall be entitled to temporarily or permanently block your access to the Website if there are concrete indications showing that you violate or violated these terms of use and/or applicable law or if Panasonic is legitimately interested in blocking such access. Section 12: Limitation on Liability
Panasonic’s liability for any damage caused by your use of the Services provided on the portal (including retrieval of free contents) shall be limited to cases in which the damage you suffered was caused based on the contractual use of the contents and/or Services and only in case Panasonic acted with wilful intent (including fraudulent intent) and gross negligence.

When you create an account or profile on a Panasonic website or application (such as sign up to be a Panasonic Partner), we ask you to provide certain Personal Information, including your company details, your name, email address, job title and telephone number. Any Panasonic account you create will be password-protected. We use your name and company details to give you access to a programme where benefits are linked to your activity. We ask you to select the categories you want to have access to and we check with our sales representative your company is entitled to access these categories. We identify you and your company profile, in order to define what your type of access should be, according to your company profile (distributor, reseller, rental,..). We use these information to provide you with a personalized web site access, where content is defined by your country, your profile and the categories you have been approved for. Panasonic have put in place appropriate rigorous physical and technical measures to safeguard the Personal Information we collect in connection with our Services. However, please note that although we take appropriate rigorous steps to protect your Personal Information, no website, product, device, online application or transmission of data, computer system or wireless connection is completely secure and therefore we cannot guarantee the security of your Personal Information.

Encryption
All Personal Information you provide to us is stored on our secure servers. Where we have given you (or where you have chosen) a password that enables you to access certain Services, such as you My Panasonic Profile, you are responsible for keeping this password confidential and we ask you not to share your password with anyone.
Other security measures
Information security, including the protection of Personal Information is organized in a global Panasonic Program called “Information Security Management” (ISM). The aim, standards and implementation measures are organized in a globally valid Policy, standards and guidelines. All central European IT systems are externally assessed and fall under the regulation of ISO 27001 certification. The program and all its parts follow a strong yearly PDCA approach to secure the confidentiality, integrity and availability of all data for the whole information lifecycle from collection to destruction of such information.
Using social media and forum features
Certain Services include social networking, chat room or forum features. You should ensure that when using these features that you do not submit any personal Information that you do not want to be seen, collected or used by other users.

Panasonic will collect, store and process your Personal Information in accordance with your rights under any applicable data protection laws.

8. Data Retention ? How long we will store/keep your Personal Information
We will retain your Personal Information for the period necessary to fulfil the purposes for which your Personal Information has been collected.
In particular, we classify Personal Information into the following specific categories with different retention periods:

Competition entrants - 1 year.

Marketing opt-ins - Will remain as an opt-in until you unsubscribe at which point your information will be retained on a suppression list in order to ensure that we comply with your request.

Contact us sales forms or inbound telephone sales inquiries - 1 year.

Warranty registrations and customer service calls - 5 years. We may need to contact you in case of product recalls (health and safety).

Customers and partners - 6 years from the last time we engage with you (email, meeting, telephone call).
Please note: If your Personal Information belongs to more than one category, the longest retention period will prevail. When your Personal Information is no longer required for the purpose it was collected or as required by applicable law, it will be deleted and/or returned to you in accordance with applicable law.

We and other Panasonic Affiliates may use your Personal Information (such as your contact details (e.g. name, address, email address, telephone number)) to send you marketing-related correspondence by post, email, telephone and/or text message (SMS) related to Panasonic products, devices and other Services in accordance with your email and contact preferences Panasonic Subscription Centre.or as you otherwise agree to.
When you purchase Panasonic products or device, contact our customer support representatives, create an account or profile for one of our Services (such as a My Panasonic Profile or eShop account), or subscribe to one of our Services, you may be given the opportunity to opt-in to (or where permitted by applicable law, opt-out of) the receiving of such marketing-related correspondence.
We do not share Personal Information with third parties for the third parties’ marketing purposes.
